T-Buy Srl acts as an agent on behalf of Maserati S.p.A., Viale Ciro Menotti 322, 41121 Modena (MO), Italy (hereafter known as Maserati) for the sale of products offered through the e-commerce site (internet) http://www.maseratistore.com/. In the event that a commercial transaction is formulated, the site is used exclusively by the Vendor even though, it is understood that Maserati shall be the only holder of rights concerning domains, logos, trademarks and copyrights used on the site and on the products.


1. Contents of the general sales conditions

The following general sales conditions apply to all the sales contracts between the Purchaser and the Vendor through the site maseratistore.com. Every contract is subject to the general sales conditions version published on the site at the time when the contract is finalized (see art.3).


Purchaser' shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a “Purchaser”, please refrain from buying any products from maseratistore.com


Any alteration proposed by the Purchaser will not change the general conditions of sale unless they are expressly accepted in writing by the Vendor.


2. Contract parties and geographical area

3. Finalizing the contract

All the information on the products published on maseratistore.com, such as technical specifications, images, dimensions or compatibility particulars are not binding and are subject to alteration at any time, unless they are expressly mentioned as being binding. In the event that the Purchaser is misled by the above indications, he may withdraw the purchase as indicated in our Return Policy.


The offers on maseratistore.com are not binding for the Vendor and do not constitute an offer to the public, but are only 'invitatio ad offerendum'. The purchase order made by the Purchaser constitutes a binding contract. The purchase order is accepted by the Vendor through an order receipt sent via e-mail; the order receipt contains part of the sale conditions, the description of the product features, the main elements of the contract (price, means of payment), the order filing and storage of data methods arranged by the Vendor as well as the correction procedures of the order content.


The Contract is finalized between the parties and becomes effective when the Purchaser receives the order receipt. The order and the order receipt are considered to be received when the parties addressed are able to access the telematic messages.


In the event that the Purchaser does not receive the order receipt or any other communication from the Vendor within 24 hours of the forwarding of the order, the Purchaser is required to contact the Vendor in reasonable time by sending an e-mail to the e-mail address:


4. Purchase of Products

The Products in the Catalogue may be purchased by selecting them and subsequently dropping them into the appropriate cart. Once the selection of Products is completed and the Purchaser wishes to proceed to the purchase of the products placed in the cart, the Purchaser will be asked to provide the data required for the purposes of establishing the Contract. In particular, the Purchaser will be required to provide personal data in a proper section of the site, an e-mail address, any additional address for the delivery of the Products (where necessary), and a telephone number where he could possibly be contacted in order to communicate the delivery date to him.


If the Purchaser chooses to pay by credit card, he will be directed to the Internet site web page of the bank providing the 'on-line' payment service, where the Purchaser must provide the credit card data through a connection to which Maserati and the Vendor have no access.


For accounting reasons, the Vendor reserves the right to verify general information left by the Purchaser. In the event of payment by credit card, the total price of the purchase will be debited to the Purchaser after the Contract is finalized.


In the event of a limited-series Product order, the Vendor may reserve the right to allow the Purchaser to purchase a limited number of products only, possibly lower than the total number of Products available for sale.


In any case, the Purchaser may submit an order for a number of Products larger than the number available indicated in the Catalogue. In such a case, the Vendor reserves the right to accept the proposal of the Purchaser for a number of pieces exceeding the maximum number indicated, subject to verification of the availability of the Products. The Vendor reserves the right, moreover, to accept the above proposal also subject to the fair distribution of the Products on the various markets. It is understood that, should it be impossible to satisfy the order of the Purchaser for the number of pieces in excess, the Contract will be settled for the maximum number of Products available.


Special 'Make to order products' are also offered for sale on the Site. They are specially assembled for the Purchaser and/or customized to suit such requirements. These products must be ordered in advance, in consideration of their high quality craftsman manufacturing, as well the personalisation.


The Purchaser may order the Make to Order Product by following the instructions on the Site and according to the specifications indicated.
The Purchaser will be allowed to pay for the mentioned Products through the means of payment provided on the Site.


5. Delivery of goods

The availability of the product is indicated on the maseratistore.com online catalogue. The delivery times indicated are not binding, unless separately indicated in another agreement. 6. Prices and dispatch costs

The price of the Products is the one indicated on the Pricelist published on the site on the day the order is made and before the order is actually issued.


The prices indicated concern deliveries to addresses within the European Union and Switzerland and include VAT. For all other countries, the final prices do not include VAT.  The additional dispatch and delivery costs will be determined on the basis of the type of delivery and destination address. These costs are indicated separately before the order is sent and in the confirmation order sent by e-mail.


The VAT rate is determined with regard to the destination country of the ordered goods. In particular, the orders made to EU countries are subject to the VAT rate in Italy, currently equal to 20%..
The orders made to other countries (e.g. Japan, U.S.A.) do not include VAT.
It is the responsibility of the Purchaser to pay taxes, duties and any other fee in his/her country of residence.


7. Payments

The orders made on maseratistore.com can be paid by credit card. The Vendor may allow additional means of payment in the dedicated section on maseratistore.com Details of the credit cards will be sent to Banca Sella which deals with payments via credit card for the Vendor.


The credit card data sent to Banca Sella while the order is being made, is protected against unauthorised access, by means of cryptographic transfer of SSL data (Secure Socket Layer) at 128 bit.


All the current browsers support SSL cryptography. This data is not accessible to third parties, nor to the Vendor or Maserati.


8. Guarantee

8.1 Legal guarantee of the Vendor

The Vendor will issue a valid guarantee for the product covering non-conformities with the quality required and declared on the contracts, according to and in application of Directive 44/99/CE.


The guarantee enables the Purchaser, in the event of a defect or non-conformity of the product, to obtain the  repair of the product (if possible), replacement of the product, a reduction of the price, or resolution of the contract by applying directly to the Vendor, within a reasonable period of time which depends on the nature of the goods.


The guarantee does not cover any use of the goods which does not comply with its intended use as established by the Vendor/Manufacturer.


Any claims must be accompanied by the evidence of their purchase (receipt, fiscal document issued by the Vendor/ proof of the payment).


8.2 Commercial warranty by the manufacturer

The Manufacturer issues a factory warranty (commercial warranty), which may be included inside the packaging. The duration, conditions and use of the warranty are indicated on the Warrant Certificate.


This warranty has no effect on the non-disposable rights of the Purchaser by virtue of law.
If the warranty certificate attached to the product does not illustrate the procedure for exercising the warranty rights in relation to the country in which the goods are received, please contact . In such cases the following information must be provided:

a. Username of the Purchaser;
b. Product series N°;
c. Product description;
d. Description of anomaly found;
e. Type of intervention required;
f. Geographic area for which the explanation is required.


8.3  Transmission of claims

The claim must be promptly exercised by the Purchaser an no later than 60 days from the date on which the defect was discovered. During this period the product must not be used. The claim will be submitted electronically to the Vendor which will communicate immediately to the Purchaser the nearest After Sales Point and the procedure to follow when sending the product. The After Sales Point service may be managed directly by Maserati through its own facilities instead of via the Vendor (which has no effect on the Vendor's responsibility).


9. Responsibility for the product

The contents of Directive 85/374/CEE regarding damage caused by the product are valid. The Vendor, acting as the distributor, waives all responsibility by indicating the name of the manufacturer.


10. Copyright

All the contents of maseratistore.com are protected by copyrights. All rights belong to Maserati.


This Internet site may not be reproduced in whole or in part, transferred using electronic or traditional methods, modified, linked and used for public or commercial purposes without the prior written consent of Maserati.


11. Applicable legislation and jurisdiction

11.1 The legislation applicable is the Italian law, but the Purchaser cannot be denied rights applicable by the Laws in his own country.


11.2 Any disputes which may arise or are related to these “General Sales Terms and Conditions will be referred to the jurisdiction of the Court as defined by the Consumer Code regulations (Legislative Decree n. 206 dated September 6 2005). If there are professional business relations between the Parties all disputes will be the jurisdiction of the Court of Milan


12. Conclusive arrangements

If any clause of the present general terms and conditions should be invalid or should become invalid at a later date, this will not effect the validity of the rest of the present contract and the invalid clause shall be replaced with a clause that represents as faithfully as possible the original intent and economic purposes of the Parties or with an appropriate legal arrangement.


The Vendor reserves the right to amend the present general terms and conditions at any time. The amended general terms and conditions will be made accessible on the site http://maseratistore.com/.


13. Security

All user data are protected to the best of our abilities against loss, falsification, manipulation and improper use by third parties.


We guarantee:
- maximum levels of reliability and security to ensure consumers that the site is protected.
- that the information sent through the Web browsers or other devices remains strictly confidential.

14. Return Policy and Right of Withdrawal

A) Purchasing of products

If for any reason the Purchaser is not satisfied with the purchase, he will have the right to withdraw from the Contract, with no penalty, specifying the reasons for withdrawal in the Return of Goods Form within 15 working days from the delivery.


The Purchaser may exercise his right of withdrawal within the above terms and using the procedure specified herewith and in the HELP section of the site, after completing the Return of Goods Form, in order to receive the correspondent Return Code (RMA).


The return of products must be made, at the Purchaser's expense, to the following address:

The products must be returned in the same condition as they were received, that is, in a perfect state of conservation, complete with all their unused components, with the original packaging and with any attached manuals.


The Purchaser will be responsible for all transport risks during the return of Products.


The Vendor will accept delivery of the returned Products, reserving the right to verify that the same have been returned in the same condition as they were when delivered to the Purchaser.


If necessary, the Purchaser shall replace the original wrappings on the Products with additional protective packaging to preserve and protect them during delivery; all necessary stickers and labels should also be applied.


The Vendor will refund the Purchaser the total amount paid for the purchase of the Products with no charge except for transport costs and possible duties, within the terms set by law, and on condition that the Products have been returned in accordance with the above.


The aforementioned refund will be carried out by means of crediting or returning the amounts paid by the Purchaser for the products using the same means of payment used for the purchase.


In the event of purchase by credit card, the refund time will depend on the credit card used but in any case will be completed within a timeframe of two bank statements.


The Purchaser will not be entitled to exercise the right of withdrawal for audiovisual or sealed I.T. software products that have already been opened. Similarly, the Purchaser is not entitled to exercise the right of withdrawal for Make To Order Products or for those Products which, due to their nature, run the risk of deterioration or rapid alteration of their condition.


B) Faulty products

The Purchaser will be entitled to return any faulty Product/s writing 10 days from detecting the defect.


The Vendor will accept the return of faulty products, reserving all rights to inspect and test the product to assess relative quality levels or non-conformities.


If the tests confirm a non-conformity, the Vendor will refund the Purchaser for all costs incurred to return the faulty product, and replace the Product with an equivalent item or refund the purchase price plus all delivery expenses.


The aforementioned refund will be carried out by means of crediting or returning the amounts paid by the Purchaser for the products using the same means of payment used for the purchase.


In the event of purchase by credit card, the refund time will depend on the credit card used but in any case will be completed within a timeframe of two bank statements


What happens if no-one is home when the goods are delivered?
If no-one is home when the goods are delivered or the person authorised to receive the goods is absent, our courier will leave a message and, for deliveries outside Italy, will telephone the client to arrange a new delivery date using the number given when placing the order on the site.


Do you charge extra for deliveries outside Europe?
Deliveries to destinations outside the European union could cost more and be subject to taxation, all of which are charged to the recipient.
